1. COMPANY INFORMATION
This Terms of Service agreement (“Agreement”) is entered into between Waremodel, a remodeling company located at 333 Suite 101, 25248 Pacific Hwy S, Kent, WA 98032 (“Company,” “we,” “us,” or “our”), and the customer (“Customer,” “you,” or “your”).
2. SERVICES PROVIDED
Company specializes in bathroom and kitchen remodeling services, including but not limited to:
Bathroom Remodeling:
- Demolition – Safe removal of existing fixtures, tiles, and materials
- Tile Installation – Professional installation of ceramic, porcelain, and natural stone tiles
- Cabinet Installation – Custom and pre-fabricated cabinet mounting and fitting
- Drywall Replacement and Installation – Complete drywall services including repair and new installation
- Painting – Interior painting services for remodeled spaces
- Hardwood and Laminate Installation – Professional flooring installation services
- Plumbing Services – Toilet and bathtub installation and related plumbing work
Kitchen Remodeling:
- Kitchen Demolition – Safe removal of existing cabinets, countertops, and appliances
- Custom Cabinet Installation – Full kitchen cabinet design and installation
- Countertop Installation – Granite, quartz, marble, and laminate countertop installation
- Backsplash Installation – Tile and stone backsplash design and installation
- Kitchen Flooring – Hardwood, laminate, tile, and vinyl flooring installation
- Kitchen Painting – Complete interior painting services
- Plumbing Work – Sink installation, dishwasher hookup, and kitchen plumbing modifications
- Electrical Work Coordination – Coordination with licensed electricians for lighting and appliance installation
3. ACCEPTANCE OF TERMS
By engaging our services, signing a contract, or making payment for services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not proceed with our services.
4. CONTRACT AND SCOPE OF WORK
4.1 Written Estimates
All work will be performed based on a written estimate and contract that specifies:
- Detailed scope of work
- Materials to be used
- Timeline for completion
- Total cost and payment schedule
- Any specific warranties or guarantees
4.2 Change Orders
Any changes to the original scope of work must be documented in writing and signed by both parties. Additional charges may apply for change orders.
5. PAYMENT TERMS
5.1 Payment Schedule
- Deposit required before work begins (typically 10-25% of total project cost)
- Progress payments as outlined in the contract
- Final payment due upon completion and customer satisfaction
5.2 Late Payments
Late payments may result in work stoppage and may incur interest charges of 1.5% per month or the maximum allowed by Washington State law, whichever is less.
6. WARRANTIES AND GUARANTEES
6.1 Workmanship Warranty
We provide a one (1) year warranty on our workmanship from the date of project completion.
6.2 Materials Warranty
Materials are covered by manufacturer warranties. We will assist in warranty claims but are not responsible for defective materials beyond our control.
6.3 Warranty Limitations
Warranties do not cover:
- Normal wear and tear
- Damage caused by misuse or negligence
- Issues arising from customer-supplied materials
- Damage from natural disasters or acts of God
7. CUSTOMER RESPONSIBILITIES
7.1 Site Access
Customer must provide reasonable access to work areas during agreed-upon hours.
7.2 Utilities
Customer is responsible for ensuring adequate utilities (water, electricity) are available at the work site.
7.3 Personal Property
Customer must remove or protect personal property. Company is not responsible for damage to items not moved or protected.
7.4 Permits
Unless otherwise specified, customer is responsible for obtaining necessary permits. Company can assist with permit applications for an additional fee.
7.5 Parking and Site Access
Customer must provide adequate parking space for company vehicles and equipment. If street parking is required, customer is responsible for any parking fees or permits required by local authorities.
7.6 Working Hours Acknowledgment
Customer acknowledges that construction work may involve noise and dust. Standard working hours are 8:00 AM to 6:00 PM, Monday through Saturday, unless otherwise agreed in writing.
8. SUBCONTRACTORS AND THIRD PARTIES
8.1 Use of Subcontractors
Company reserves the right to engage qualified subcontractors for specialized work including but not limited to electrical, plumbing, HVAC, or other licensed trades. All subcontractors are properly licensed and insured.
8.2 Subcontractor Responsibility
Company is responsible for coordinating and supervising all subcontractors. Customer concerns regarding subcontractor work should be directed to Company management.
9. HEALTH AND SAFETY PROTOCOLS
9.1 Health and Safety Measures
Company follows all applicable health and safety guidelines. This may include wearing masks, maintaining social distancing, and implementing sanitization protocols as required by local health authorities.
9.2 Sick Policy
Company workers who show signs of illness will not report to work sites. If work needs to be postponed due to health concerns, alternate scheduling will be arranged.
10. DOCUMENTATION AND PHOTOGRAPHY
10.1 Work Documentation
Company may photograph or video record work progress for documentation, quality control, and portfolio purposes. These images may be used for marketing materials, website content, and social media with customer consent.
10.2 Before and After Photos
Customer grants permission for Company to take before and after photos of the project area. Customer may opt out of marketing use by providing written notice.
11. WASTE DISPOSAL AND CLEANUP
11.1 Construction Debris
Company is responsible for disposal of materials removed during demolition and construction debris generated by our work. Disposal costs are included in project pricing unless otherwise specified.
11.2 Daily Cleanup
Company will maintain a reasonably clean and safe work area during the project and perform final cleanup upon completion.
11.3 Hazardous Materials
If hazardous materials (asbestos, lead paint, etc.) are encountered, work may be suspended pending proper remediation. Customer is responsible for remediation costs.
12. SEASONAL AND WEATHER CONSIDERATIONS
12.1 Weather-Related Delays
Certain work may be affected by weather conditions. Company is not liable for delays caused by extreme weather, natural disasters, or conditions that make work unsafe or impractical.
12.2 Seasonal Limitations
Some materials and techniques may have temperature or humidity requirements. Company will advise customers of any seasonal limitations affecting their project.
12.3 Climate Control
Customer is responsible for maintaining adequate temperature and ventilation in work areas. Some materials require specific environmental conditions for proper installation.
13. EMERGENCY PROCEDURES
13.1 Utility Emergencies
In case of water, gas, or electrical emergencies during work, Company will immediately shut off affected utilities and contact appropriate emergency services. Customer will be notified immediately.
13.2 Structural Issues
If unexpected structural problems are discovered, work will be stopped until a structural engineer can assess the situation. Additional costs for engineering consultation and repairs are customer’s responsibility.
13.3 Emergency Contacts
Customer must provide current emergency contact information and be available for urgent decisions during work hours.
14. LIABILITY AND INSURANCE
14.1 Insurance Coverage
Company maintains general liability insurance and workers’ compensation insurance as required by Washington State law.
14.2 Limitation of Liability
Company’s liability is limited to the contract amount. We are not liable for consequential, incidental, or punitive damages.
14.3 Property Damage
While we take precautions to protect your property, older homes may have hidden conditions that could result in unexpected issues during demolition or installation.
15. DELAYS AND FORCE MAJEURE
Project timelines are estimates. Company is not liable for delays caused by:
- Weather conditions
- Material delivery delays
- Permit delays
- Unforeseen conditions (plumbing, electrical, structural issues)
- Acts of God, natural disasters, or other circumstances beyond our control
16. CANCELLATION POLICY
16.1 Customer Cancellation
Customer may cancel within 72 hours of signing the contract. After work begins, customer is responsible for costs incurred and a reasonable profit margin.
16.2 Company Cancellation
Company reserves the right to cancel contracts for non-payment, unsafe working conditions, or customer interference with work progress.
17. DISPUTE RESOLUTION
17.1 Governing Law
This agreement is governed by the laws of Washington State.
17.2 Dispute Resolution Process
- Direct negotiation between parties
- Mediation through a neutral third party
- Binding arbitration if mediation fails
- Court proceedings as a last resort
All disputes will be resolved in King County, Washington.
18. SAFETY AND COMPLIANCE
18.1 Safety Standards
All work will be performed in accordance with local building codes, OSHA safety standards, and industry best practices.
18.2 Lead Paint and Asbestos
For homes built before 1978, customer acknowledges potential presence of lead paint or asbestos. Additional testing and remediation may be required at customer’s expense.
19. INTELLECTUAL PROPERTY
Any custom designs, plans, or specifications created by Company remain our intellectual property unless specifically transferred in writing.
20. PRIVACY POLICY
We respect customer privacy and will not share personal information except as required by law or for business purposes directly related to the project.
21. SEVERABILITY
If any provision of this agreement is found unenforceable, the remaining provisions will continue in full effect.
22. MODIFICATIONS
This agreement may only be modified in writing and signed by both parties.
23. ENTIRE AGREEMENT
This Terms of Service, together with the project contract, constitutes the entire agreement between the parties.
